Welcome to QPost ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of the QPost website, APIs, CLI tools, and related services (collectively, the "Service").

By creating an account, connecting your social media accounts, or using any part of QPost, you agree to these Terms. If you do not agree, do not use the Service.

1. Overview

QPost is a social media management and automation platform designed for independent developers and small teams. It enables users to schedule, publish, and analyze content across multiple platforms, starting with YouTube, TikTok, and Instagram.

2. Eligibility

To use QPost, you must: • Be at least 16 years old (or the age of digital consent in your jurisdiction). • Have the legal authority to enter into these Terms. • Use QPost only for lawful purposes. If you are using QPost on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Account Registration

You must register for an account to use the Service. You agree to: • Provide accurate and complete information. • Maintain the security of your credentials. • Be responsible for all activities under your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Acceptable Use

You agree not to: • Use QPost for unlawful, harmful, or misleading purposes. • Interfere with, disrupt, or reverse-engineer the Service. • Circumvent rate limits, quotas, or security features. • Automate actions in ways that violate the policies of connected platforms (e.g., YouTube, TikTok, Instagram). • Resell or redistribute QPost APIs or accounts without our written consent. We may suspend or remove accounts or content violating these rules.

5. Third-Party Platforms

QPost connects to external social platforms via their public APIs. You acknowledge that: • Each connected platform has its own terms and privacy policies. • Your use of those services through QPost is subject to their rules. • QPost is not responsible for downtime, API changes, or data loss caused by those external services.

6. Subscriptions & Payments

QPost offers free and paid plans. • Paid subscriptions are billed monthly or annually in advance. • Fees are non-refundable, except where required by law. • Prices may change with notice. • Failure to pay may result in suspension or termination of your account. All payments are processed securely through trusted third-party payment providers.

7. API & Developer Access

QPost provides REST and GraphQL APIs for automation. You agree to: • Use APIs within documented rate limits. • Protect your API keys and tokens. • Not exploit or resell API access. We may revoke API access at any time for abuse or violations.

8. Intellectual Property

All rights, title, and interest in the QPost Service — including software, branding, and documentation — remain with QPost. You retain ownership of your own content and grant QPost a limited, worldwide license to host, process, and transmit your content solely to provide the Service.

9. Termination

You may close your account at any time. We may suspend or terminate your account if: • You violate these Terms. • You misuse the Service. • Required by law or by a third-party platform partner. Upon termination, we may delete your data unless retention is legally required.

10. Disclaimers

The Service is provided "as is" and "as available." QPost makes no warranties regarding: • Uptime or error-free operation. • Accuracy of analytics data. • Compatibility or continued access to third-party APIs. You use QPost at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law: • QPost and its affiliates are not liable for indirect, incidental, or consequential damages. • Our total liability for any claim will not exceed the amount you paid in the previous three (3) months. Certain jurisdictions may not allow these limitations; in that case, they apply only to the extent permitted.

12. Changes to These Terms

We may update these Terms periodically. Material changes will be announced via the website or by email. Continued use after updates constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Canada, specifically the province of British Columbia, without regard to its conflict of law principles. Any dispute will be resolved in the provincial or federal courts located in British Columbia, Canada.
